Court rules in favor of W.Ky. industrial park bond issue

FRANKFORT - Franklin County Circuit Court correctly upheld the Warren County Debt Commission's approval of a $25 million bond issue for a proposed airport and industrial park complex, the Kentucky Court of Appeals ruled Friday.

In a 3-0 decision, the appellate court supported the lower court's ruling that there was "substantial evidence" to approve the bond issue.

The appeals court also agreed that the statutory prerequisites for the bond issue were satisfied.

"In examining this evidence, we must conclude that it satisfies the statutory requirement for the bond issue and constitutes substantial evidence in support of the (State Local Debt Officer) and the (Warren County Debt Commission's) decision," Judge Daniel Guidugli wrote.

The debate centered on funding for construction of the planned 4,600-acre Kentucky Trimodal Transpark near Bowling Green. The bond issue for the project had already been approved by a state local debt officer, and was affirmed by the Warren County Debt Commission.

Franklin County Circuit Court upheld the commission's decision June 27.
