Report issued on shooting
Kentucky officer 'acted inappropriately' in fatal incident

OWENSBORO, Ky. An internal police report said an officer acted inappropriately in the fatal shooting of a black motorist.
The report was submitted to a Daviess County grand jury, which refused to indict Officer Lorhn Frazier on April 4.
Mr. Frazier shot Tyrone Clayton Jr. on Nov. 16 as the suspect was attempting to flee in a stolen vehicle following a foot chase after being stopped for suspicion of reckless driving.
The report, which was released to the Owensboro Messenger-Inquirer on Thursday by Coroner Bob Howe, criticized Officer Frazier for firing a second shot through the driver's side window that struck Mr. Clayton in the chest.
A coroner's report said the second shot was the fatal one.
The report was part of a nearly 600-page investigation turned over to the grand jury. Civil Rights organizations protested the shooting as unnecessary.
Mr. Clayton was driving toward Officer Frazier in a car he had found idling during a foot chase when the officer fired the first shot through the windshield, the report said.
It struck the suspect in the arm.
Mr. Clayton had struck Officer Frazier in the leg with the car just before the shooting, the report said. Officer Frazier was on the driver's side of the car when he fired the second shot, the report said.
Owensboro Police Capt. Steve Kimble said in his report that Officer Frazier was no longer in danger of being run over when he fired the fatal shot.
Mr. Kimble would not comment on the report Thursday.
In the report, Officer Frazier said less than one second separated the shots and that he fired at Mr. Clayton in self-defense.
Investigators ruled that Officer Frazier acted appropriately by firing the first shot because he was in the path of the car and his life was in danger.
Officer Frazier returned to work Monday in the evidence collection unit.
