LEBANON -- A woman who awoke in her car with her pants down drove straight to the Springboro Police Department March 5 with the man she says sexually assaulted her while she was unconscious.
Bert C. Johnson, II, 39, of 7551 Pisgah Drive in West Chester, has been indicted on two counts of sexual battery by a Warren County grand jury. The indictment was announced Monday.
Mr. Johnson and the 24-year-old woman spent the evening drinking at several bars before Mr. Johnson allegedly drove the woman's car to the Stone Ridge subdivision, said Errol Butt, chief investigator for the prosecutor's office. Once there, the woman fell asleep and Mr. Johnson allegedly performed a sexual act with her, Mr. Butt said.
"When she woke up sometime later, her pants were down and there was a confrontation between the victim and the defendant," Mr. Butt said. "The victim drove her vehicle to the Springboro Police Department and the defendant rode with her."
Mr. Butt said Mr. Johnson waited while the woman reported the crime and then cooperated with police. If convicted, he could be sentenced to one to five years in prison.
In another case, a man and a woman from Middletown were indicted on drug charges after an undercover police officer from Carlisle bought two rocks of crack cocaine from them at a gas station on Central Avenue on Nov. 13.
Price Fugate, 53, of Malvern Street, and Jeanne L. Heater, 34, of Elwood Street, were indicted on possession of cocaine and trafficking in cocaine charges. Ms. Heater also was indicted on one count of permitting drug abuse.
After the pair allegedly sold cocaine to the undercover officer, their car was stopped on Central Avenue by uniformed police, Mr. Butt said. Inside the car, police allegedly found 13.7 grams of cocaine.
Also, Douglas I. Procter, 36, of Dayton, Ohio, was indicted on one count of possession of cocaine after a Warren County sheriff's deputy allegedly found 15.2 grams of crack cocaine in Mr. Procter's car during a traffic stop.
The sheriff's deputy pulled Mr. Procter over at 4 a.m. Feb. 21 at the intersection of Summit and Columbus avenues in Lebanon after he allegedly sat through a green light and drove through a red light, Mr. Butt said.
